PATIENT’S AGREEMENT REGARDING THE PROCESSING OF PERSONAL DATA (GDPR)
Pursuant to the provisions of European Regulation 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and pursuant to national law with all subsequent amendments and completions, the Parties agree to conclude this Agreement.
Article 1
For the purposes of this Agreement, the following terms and expressions have the following meanings:
• PERSONAL DATA: any information relating to an identified or identifiable natural person.
• PROCESSING: any operation that includes the collection, registration, organization, structuring, storage, adaptation or modification, extraction, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, deletion or destruction personal data.
Article 2
In accordance with REGULATION no. 679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (General Data Protection Regulation), CMD DR. LUKÁCS Á. ATTILA – located in Jud. Harghita, Ditrău, Str. Dealul Frumos 2/1/2, CUI – has the obligation to administer in safe conditions and only for the specified purposes, for an indefinite period, the personal data provided by the PATIENT about himself, a member of his family or another person, patient , of the Clinic. The role of this agreement is to explain how the PATIENT’s personal data are processed, the purpose for which they are used and the rights conferred on you by law.
Article 3
The purpose of PROCESSING personal data is in accordance with the applicable legal provisions in force and includes the identification of the person, diagnosis and completion of the patient’s medical history, any subsequent medical references, statistical reports, reported to the sending doctor, the Insurance House of Local Health or National Health Insurance House or other organizations authorized by law in this regard or the permanent improvement of the quality of services provided. In order to provide specialized medical services, to perform the necessary interventions according to the diagnosis and the approved treatment or rehabilitation plan, your personal data may be transmitted to external collaborating doctors, dental technicians, collaborating medical analysis laboratories, public authorities or other competent persons. by law to request this data, but always making sure that we establish adequate guarantees for the protection of your data (based on standard contractual clauses, etc.).
The personal data provided by the PATIENT is necessary for the recording and processing of information related to the history and diagnosis you have requested. Your refusal may determine the impossibility of medical referral of the investigation you want to perform, thus canceling the appointment and may lead to the refusal to perform the medical act. If you have agreed to have your health data shared with others (eg close relatives), the operator will provide this information according to your instructions.
Article 4
The legal basis for the collection and processing of data requested for the purpose mentioned above is:
the right of access to personal data;
• your express consent to the processing of personal data;
• informed consent to which you are a party;
• legal obligation arising as a result of the legal relationship between you and the clinic.
We have the obligation to notify you in real time if we will make any transfer of personal data in a country in the European Union or outside the European Economic Area.
Personal data will be kept for as long as necessary to fulfill the purpose mentioned above or in the exercise of a public interest, within a period of time provided by legal provisions and in accordance with the provisions of the GDPR (Regulation).
You are granted any of the following rights under the conditions specified by the GDPR (European Data Protection Regulation 679/2016 *), namely:
• the right to request rectification or updating when data are inaccurate or incomplete;
• the right to request the deletion of data in certain circumstances (eg when personal data are no longer needed in relation to the purpose mentioned above);
• the right to request the restriction of processing in certain circumstances (eg when you dispute the accuracy of the data – for the period that would allow us to verify the accuracy of that data);
• the right to lodge a complaint with us and / or with the competent data protection authority;
• the right to oppose the processing;
• the right to withdraw your consent, at any time, for the processing of personal data, to which you have previously consented;
• the right to be forgotten, in the sense of addressing a request to CMD DR. LUKÁCS ATTILA for deleting records of personal data from our database;
• the right to data portability, in the sense of transferring personal data to another personal data controller designated by you;
• the right to be notified by the controller in case of data security breaches.
